Terms of Use

These terms are an agreement between you and Veilbreak Games, LLC ("we", "us") for the Retro Offroad game and its online features. By playing the game, or by tapping LET'S RACE or ACCEPT in the game, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the game.

1. Who can play

The game is for players aged 13 and over. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you. If you use the game on behalf of anyone else, you confirm you may accept these terms for them.

2. Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to use the game on devices you own or control, for your own non-commercial entertainment, subject to these terms and the rules of the app store you got it from. You may not copy, modify, sell, rent or distribute the game, reverse-engineer it except where the law allows, or use bots, scripts or modified clients to interact with our online services.

3. Guest accounts and online features

Rankings, friends and race teams use an anonymous guest account that the game creates for you. It isn't linked to your email or phone number, so if you uninstall the game, reset your device or change phones, we may not be able to restore it. Your career save is stored on your device (see the Privacy Policy). You can delete your online account at any time from the Profile screen.

Online features need an internet connection and may change, pause or end, for example for maintenance, safety or legal reasons, or because an update is required. The offline game remains playable.

4. Player content and conduct: zero tolerance for abuse

Other players see the names you choose (your display name, team name and team tag) and your results. You are responsible for them. We do not tolerate objectionable content or abusive behaviour. You must not create or use names, or behave in ways, that:

The game filters names, and you can report or block any player or team by tapping their name. We review reports within 24 hours. We may remove content, reset names, remove leaderboard times, remove players from teams, and suspend or permanently ban accounts or devices that break these rules, with or without notice. Blocking a player hides them from you and stops their friend requests.

5. Fair play

Cheating is not allowed. That includes modified or automated clients, exploiting bugs, tampering with times, team banks or network traffic, and using several accounts to gain an advantage. We may remove times or team funds that we believe were not earned fairly, and suspend the accounts involved.

6. In-game money and items

In-game money, prizes, trucks, upgrades, nitro, team banks and sponsor levels are part of the game. They have no real-world value, can't be exchanged for money or anything of value, can't be transferred or sold, and aren't your property. We may change, rebalance or reset them, for example to fix bugs or cheating.

7. Race teams

Team members pay a share of their race winnings (the team cut) into the team bank, which the team owner can spend on sponsor deals for the team. Contributions can't be taken back when you leave. An owner can hand the team over or remove members. If an owner is inactive for 30 days, another member can claim the team.

8. Our content

The game, including its code, artwork, music, sounds, names and logos, belongs to us or our licensors and is protected by law. These terms don't give you any rights to it beyond the licence above.

9. Updates and changes

We may update the game, for example to add features or fix problems, and some updates may be required to keep using online features. We may change these terms. If a change is significant, we'll ask you to review and accept it in the game before you next use the online features. The version on this page applies from its effective date.

10. Ending this agreement

You can stop playing at any time and delete your online account from the Profile screen. We may suspend or end your access to online features if you break these terms, if the law requires it, or if we stop offering the service.

11. Disclaimers

The game is provided "as is" and "as available". To the extent the law allows, we don't promise that it will be uninterrupted, error-free or always available, or that data (including your save or rankings) will never be lost. Nothing in these terms limits rights you have as a consumer that can't be limited by contract.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, progress or in-game items, and our total liability to you for any claim about the game is limited to the amount you paid us for it in the 12 months before the claim (or USD 50 if more). Some places don't allow these limits, so they may not apply to you. We are responsible for foreseeable loss caused by our breach of these terms or our negligence where the law says so.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, and disputes will be handled by the courts of the state and federal courts located in New Castle County, Delaware, unless the law of the country where you live requires otherwise (for example, if you are a consumer in the EU or UK, you may also bring a claim in your local courts and keep the protection of your local consumer law).

14. App store terms

If you downloaded the game from Apple's App Store: these terms are between you and us, not Apple. Apple is not responsible for the game or its content, has no obligation to provide maintenance or support, and is not responsible for any claims about the game (including product liability, legal or regulatory compliance, or intellectual-property claims), which are our responsibility to the extent these terms say so. If the game fails to conform to any applicable warranty, you may notify Apple for a refund of any purchase price, and Apple has no other warranty obligation. You confirm you are not in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If you downloaded the game from Google Play, Google Play's terms also apply.
